- Synopsis
- The Deprivation of Liberty Safeguards (DoLS) came into force in April 2009 and form part of the Mental Capacity Act 2005 (the Act). The Act is a wide-ranging piece of legislation that governs the care, treatment and finances of adults who lack capacity to consent or make decisions in these areas. The Act is like a book with a series of chapters and paragraphs (known as ‘parts’ and ‘sections’ in law) that introduce different powers or procedures. They include: • Assessing whether a person has capacity • What is in a person’s best interests if they lack capacity • Advance decisions (often called ‘living wills’) • Restraining people who lack capacity to prevent harm to them • Lasting powers of attorney • The Court of Protection • Deprivation of Liberty Safeguards
