OUR AGE IS CHARACTERIZED by an uncertainty about the na­ ture of moral obligations, about what one can hope for in an afterlife, and about the limits of human knowledge. These uncertainties were captured by Immanuel Kant in his Critique of Pure Reason, where he noted three basic human questions: what can we know, what ought we to do, and what can we hope for. Those questions and the uncer­ tainties about their answers still in great part define our cultural per­ spective. In particular, we are not clear about the foundations of ethics, or about their relationship to religion and to science. This volume brings together previously published essays that focus on these inter­ relationships and their uncertainties. It offers an attempt to sketch the interrelationship among three major intellectual efforts: determining moral obligations, the ultimate purpose and goals of man and the cosmos, and the nature of empirical reality. Though imperfect, it is an effort to frame the unity of the human condition, which is captured in part by ethics, in part by religion, and in part by the sciences. Put another way, this collection of essays springs from an attempt to see the unity of humans who engage in the diverse roles of valuers, be­ lievers, and knowers, while still remaining single, individual humans.

Das Rundfunkrecht weist in vieler Hinsicht fur die Verfassungs­ und Verwaltungsrechtswissenschaft ungewohnte Form- und Inhalts­ probleme auf, die sich auf der Grundlage der herkommlichen Voll­ ziehungstypik nur unzureichend losen lassen. Die vorliegende Arbeit geht deshalb von der Uberlegung aus, daB die rechtswissenschaftliche Auseinandersetzung mit dem Phanomen Rundfunk bei den verfassungs­ rechtlichen Funktionsbedingungen anzusetzen hat. Es gilt zunachst, die individualrechtlichen und die institutionellen Elemente im Konzept der Rundfunkfreiheit in ihrer Zuordnung aufeinander zu bestimmen und zur Entfaltung zu bringen. Erst auf der Grundlage eines komplexen Rundfunkfreiheitsverstandnisses, das die innere Dialektik von staats­ abwehrenden Freiheitspositionen und staatlicher Funktionsverantwor­ tung fur den Rundfunk umgreift und die spezifischen medialen und technischen Wirkungsbedingungen des Rundfunks mitberiicksichtigt, gewinnen die Strukturen des Rundfunkrechts in ihrer Spannungsge­ ladenheit Gestalt und eroffnet sich ein sachangemessener Zugang zu den aktuellen rundfunkpolitischen Streitfragen, insbesondere zum Pro­ blem des offentlichen Veranstaltungsmonopols und zur Frage der An­ forderungen an einen Privatrundfunk. Insofern als es hier darum geht, die Eigenstandigkeit des Rundfunkrechts thematisch und me­ thodisch zur Geltung zu bringen, versteht sich diese Arbeit als ein Beitrag zur Entwicklung einer eigenstandigen Rundfunkrechtswissen­ schaft. 1m Zeitpunkt des Abschlusses dieser Untersuchung waren die parla­ mentarischen Beratungen uber die Regierungsvorlage betreffend ein Mediengesetz (2 BIg sten Prot NR 15. GP) noch im Gange. 1m Hin­ blick auf den ungewissen Ausgang dieser Beratungen wurden die vom Mediengesetz neu zu regelnden Fragen deszivil- bzw strafrechtlichen Personlichkeitsschutzes gegenuber den Medien sowie des Entgegnungs­ rechts aus der vorliegenden Arbeit ausgeklammert.

The Theory of Beauty in the Classical Aesthetics of Japan

The Japanese sense of beauty as actualized in innumerable works of art, both linguistic and non-linguistic, has often been spoken of as something strange to, and remote from, the Western taste. It is, in fact, so radically different from what in the West is ordinarily associated with aesthetic experience that it even tends to give an impression of being mysterious, enigmatic or esoteric. This state of affairs comes from the fact that there is a peculiar kind of metaphysics, based on a realization of the simultaneous semantic articulation of consciousness and the external reality, dominating the whole functional domain of the Japanese sense of beauty, without an understanding of which the so-called 'mystery' of Japanese aesthetics would remain incomprehensible. The present work primarily purports to clarify the keynotes of the artistic experiences that are typical of Japanese culture, in terms of a special philosophical structure underlying them. It consists of two main parts: (1) Preliminary Essays, in which the major philosophical ideas relating to beauty will be given a theoretical elucidation, and (2) a selection of Classical Texts representative of Japanese aesthetics in widely divergent fields of linguistic and extra-linguistic art such as the theories of waka-poetry, Noh play, the art of tea, and haiku. The second part is related to the first by way of a concrete illustration, providing as it does philological materials on which are based the philosophical considerations of the first part.

Das sind einerseits die objektiven Daten der wirtschaftlichen und rechtlichen Rahmenbedingungen und andererseits die persönlichen Daten des Klienten, wie seine Vermögensverhältnisse, seine persönliche Risikostruktur sowie seine Zukunftserwartungen. Ergebnis dieser Analyse muß es sein, objektive und subjektive Daten in einem Modell zu vereinigen und mit den häufig widersprüchlichen Vorstellungen des Kunden in Einklang zu bringen. Dieses Buch hat die Vertiefung eines Vortrages zum Gegenstand, den ich unter dem Thema "Zwischenbllanz der Strafproze~reform" am 27. Mai 1979 vor dec Tagung der Osterreichischen Sektion der Intemationalen luristenkom­ mission in Wei~enbach am Attersee gehalten habe. Die Veroffentlichung des Originalvortrags wird zusammen mit den anderen Tagungsbeitrligen durch die Intemationale luristenkommission erfolgen. Diese Ausarbeitung halt sich in der Auswahl und in der LOsung der behandelten Probleme sowie zum Tell auch in der Darstellungsweise im wesentlichen an diesen Vortrag. Hinzuge­ kommen ist ein Abschnitt tiber die Einflihrung von Elementen des Partei­ verfahrens in die Hauptverhandlung, weggefallen ist eine kritische Stellung­ nahme zur Reform der jetzigen Entlohnungsweise der Verfahrenshilfe, well sie nicht in den thematischen Zusammenhang dieser Arbeit pa~t. Diese Zwischenbilanz der Strafproze~reform versteht sich weniger als eine Prlisentation dessen, was in den seit Herbst 1974 laufenden Beratungen des "Arbeitskreises fUr Grundsatzfragen einer Emeuerung des Strafverfahrens­ rechts" nach mehrheitlicher Auffassung als vorlliufiges Zwischenergebnis vorzuweisen ist, sondem sie ist in erster Linie eine kritische Revision der Pro­ bleme, die in diesen Beratungen nochnicht ausgetragen oder nachmeiner per­ sonlichen Auffassung in einer Weise gekHirt worden sind, die noch grundslitz­ liche Wtinsche offenla~t. .
