Daraus ergeben sich wichtige Konsequenzen für die Verwirklichung des Klimaschutzes auf EU-Ebene, die mit dem BVerfG-Klimabeschluss abgeglichen werden. Wie können damit die UN-Ziele für eine nachhaltige Entwicklung erreicht werden, zu denen Maßnahmen zum Klimaschutz gehören (SDG 13)? Insoweit von Bedeutung sind auch die solidarischen Grundrechte vor allem in Gestalt des Umweltschutzes. Die sozialen Grundrechte hatten ihre Bewährungsprobe im Zusammenhang mit Covid 19. Ausführlich behandelt werden auch die Gleichheits- und Bürgerrechte, die justiziellen Rechte unter starkem Rückgriff auf die insoweit vielfältige EGMR-Judikatur, aber auch die jüngere EuGH-Rechtsprechung in Kartellsachen. Insgesamt erfolgt eine nähere Bewertung mit Blick auf die konkreten Konsequenzen.

Dort haben sie auch eine wichtige Funktion, um die UN-Ziele für eine nachhaltige Entwicklung zu erreichen, welche Maßnahmen zum Klimaschutz umfassen (SDG 13). Inwieweit bestehen Ansprüche auf Klimaschutz parallel zum BVerfG-Klimabeschluss? Die EGMR-Judikatur wird durchgehend stark einbezogen, ist sie doch vielfach noch immer Leitbild für die Auslegung der EGRC. Das gilt vor allem für die kommunikativen Grundrechte mit dem Dauerkonflikt zwischen Medienberichterstattung und Persönlichkeitsrecht. Insgesamt hat sich die EU-Grundrechtsdogmatik sowohl in der Rechtsprechung als auch in der Literatur erheblich fortentwickelt und wird umfassend kritisch gewürdigt – so zur Zulässigkeit der Vorratsdatenspeicherung. Das gilt auch für die neue Rolle des BVerfG zur Durchsetzung der EU-Grundrechte und für die Flüchtlingsproblematik.

Headscarves and the Court of Justice of the European Union: An Analysis of the Case Law

It puts forward arguments for a finding that workplace neutrality bans constitute direct religion or belief discrimination and examines the way that the justification test for indirect discrimination has been applied by the CJEU. The work suggests that such bans could be more successfully challenged as gender and/or racial or ethnic origin discrimination, because the protection against these forms of discrimination is stronger. It also suggests that a claim for intersectional discrimination – on the grounds of gender, racial and ethnic origin, and religion or belief – should be possible in EU anti-discrimination law. The Heart and its Attitudes
by Stephen DarwallPhilosophers don't often write about the heart. At least, analytical philosophers don't. Why is this? Philosophers are said to live life ?in their heads? rather than ?from their hearts.? But even if that is so, why don't they think and write about the heart? Moreover, it can hardly have escaped philosophers' attention that matters of the heart are central to what we human beings value most about our lives, including our lives with animals. Philosophers write a lot about friendship and love, but they tend to do so in terms that leave out heartfelt connection. They speak rather of commitment to one another and each other's well-being, or taking each other as ends, or sharing deliberative standpoints or living life together, or a whole host of other topics, and much less about mutual emotional vulnerability and sharing and being in one another's hearts. Surely one explanation of philosophers' reticence is that talk of ?the heart? seems unavoidably metaphorical. It turns out to be easy enough, however, to cash the metaphor in if we simply take ?heart? refers to a cluster of emotional susceptibilities that have an essentially reciprocating structure. The heart aims at heartfelt connection-at shared experience of joys and sorrows, hopes and fears, and other personal emotions. We seek naturally to share these feelings with others and must suppress our natural tendencies if we wish to avoid doing so. Our heart's wish is to be open to other hearts in the hope that they will be open to ours, and thereby us, in return. This book is a systematic treatment-perhaps the first-of ?attitudes of the heart?-remorse (versus guilt), love, trust, gratitude, personal anger (versus righteous anger), jealousy, and others-and their role in mediating personal relationship, attachment, and connection. This is obviously interesting in its own right, but it also shows how heartfelt attitudes mirror more extensively studied ?reactive attitudes? of guilt, resentment, and blame (?attitudes of the will?). Whereas the latter mediate moral relations of mutual respect and accountability, attitudes of the heart are the currency of heartfelt connection and personal relationship.

Encompassing forgotten and recently published historical sources, including Heidegger's Daoist and Buddhist-related reflections in his lectures and notebooks, Nelson presents a critical intercultural reinterpretation of Heidegger's philosophical journey. Nelson analyzes the intersections and differences between the Daodejing, the Zhuangzi, and Heidegger's philosophy and the linguistic and conceptual shifts in Heidegger's thinking that correlate with his encounters and interactions with Daoist, Buddhist, and East Asian texts and interlocutors. He thereby traces hints for encountering things and environments anew, models for intercultural hermeneutics, and ways of reimagining the thing, nothingness, and freedom with and beyond Heidegger's thought. This work elucidates the thing, the mystery, and freedom in Heidegger and Daoism in Part I and Heidegger's thinking of nothingness, emptiness, and the clearing in relation to Daoist and Buddhist philosophy in Part II. Hereditary: The Persistence of Biological Theories of Crime

Despite this rapid circulation, however, we still know very little about the scientific knowledge underlying these expert evaluations. Hereditary traces the historical development of biosocial criminology in the United States from the 1960s to the present, showing how the fate of this movement is intimately linked to that of the field of criminology as a whole. In claiming to identify the biological and environmental causes of so-called "antisocial" behaviors, biosocial criminologists are redefining the boundary between the normal and the pathological. Julien Larregue examines what is at stake in the development of biosocial criminology. Beyond the origins of delinquency, Larregue addresses the reconfiguration of expertise in contemporary societies, and in particular the territorial struggles between the medical and legal professions. For if the causes of crime are both biological and social, its treatment may call for medical as well as legal solutions.
