This book offers a common set of concepts to help make sense of online shaming practices, accounting for instances of discrimination and injury that morally divide readers and at times risk unjust and disproportionate harm to those under scrutiny.Digital media denunciation has become a primary form of expression and entertainment across media environments, with new socially desirable forms of accountability under movements such as #MeToo and #BlackLivesMatter addressing longstanding forms of systematic and interpersonal abuse. Building on recent scholarship on shaming, surveillance and denunciation in fixed contexts, this study generates a cross-contextual and multi-actor account of practices like ‘cancel culture’, ‘doxing’ and ‘status degradation ceremonies’. It addresses instances of moral ambivalence by discussing how digital shaming becomes normalised and embedded across socio-cultural and institutional settings. The authors establish key actors and practices in online denunciations of individuals in a range of cases and contexts, including responses to COVID-19, political polarisation, and social justice movements, as well as more local and quotidian circumstances. They draw from empirical data including interviews with nearly 100 individuals targeted by mediated shaming and/or involved in these practices, as well as ethnographic observations of digital vigilantism and discourse analysis of press coverage and online comments relating to online shaming. When people are prevented from meeting their needs, the impact is disabling, whether in the immigration system or in the wider population. Drawing on many years of research and activism, this book argues that insights from the disabled people’s movement, particularly the original Social Model of Disability, can be usefully extended to focus resistance on the disabling restrictions imposed on people subject to asylum and immigration controls.While acknowledging the pain and discomfort of many impairments and of forced displacement, the book focuses on injustices that can be changed. It does not catalogue the hostility of the ‘hostile environment’. Nor does it promote inclusive asylum restrictions. An unjust system is not transformed by including disabled people. Policies designed to deprive people of essential needs and to stoke hatred among the wider population are core elements of the rise of fascism. Europe's Passive Virtues: Deference to National Authorities in EU Free Movement Law (Oxford Studies in European Law)

The European Court of Justice has been celebrated as a central force in the creation and deepening of the EU internal market. Yet, it has also been criticized for engaging in judicial activism, restricting national regulatory autonomy, and taking away the powers of Member State institutions. In recent years, the Court appears to afford greater deference to domestic actors in free movement cases. Europe's Passive Virtues explores the scope of and reasons for this phenomenon. It enquires into the decision-making latitude given to the Member States through two doctrines: the margin of appreciation and decentralized judicial review. At the heart of the book lies an original empirical study of the European Court's free movement jurisprudence from 1974 to 2013. The analysis examines how frequently and under which circumstances the Court defers to national authorities. The results suggest that free movement law has substantially changed over the past four decades. The Court is leaving a growing range of decisions in the hands of national law-makers and judges, a trend that affects the level of scrutiny applied to Member State action, the division of powers between the European and national judiciary, and ultimately the nature of the internal market. The book argues that these new-found 'passive virtues' are linked to a series of broader political, constitutional, and institutional developments that have taken place in the EU.

It is largely based on a normative-jurisprudential approach to the procedural rules, comparing both norms and case law of the relevant courts and tribunals. The book shows the possibility of classifying “international criminal procedure” as an autonomous concept and field of study, which is constantly evolving due to the interaction of different legal cultures that characterizes this subject matter and is derived from the varied procedures as established in both statutory law and jurisprudence. Far from being an autonomous entity, international criminal procedure now represents a great compromise between the legal traditions of different ICC member States. What emerges is the historical evolution of an international criminal procedure with a unique identity, a very real “third way” between the traditional dichotomy of common law and civil law, between the Anglo-Saxon and the European Roman Law-oriented legal traditions.
