The Heart of Human Rights

This is the first attempt to provide an in-depth moral assessment of the heart of the modern human rights enterprise: the system of international legal human rights. It is international human rights law--not any philosophical theory of moral human rights or any "folk" conception of moral human rights--that serves as the lingua franca of modern human rights practice. Yet contemporary philosophers have had little to say about international legal human rights. They have tended to assume, rather than to argue, that international legal human rights, if morally justified, must mirror or at least help realize moral human rights. But this assumption is mistaken. International legal human rights, like many other legal rights, can be justified by several different types of moral considerations, of which the need to realize a corresponding moral right is only one. Further, this volume shows that some of the most important international legal human rights cannot be adequately justified by appeal to corresponding moral human rights. The problem is that the content of these international legal human rights--the full set of correlative duties--is much broader than can be justified by appealing to the morally important interests of any individual. In addition, it is necessary to examine the legitimacy of the institutions that create, interpret, and implement international human rights law and to defend the claim that international human rights law should "trump" the domestic law of even the most admirable constitutional democracies.

The Heart and its Attitudes

Philosophers don't often write about the heart. At least, analytical philosophers don't. Why is this? Philosophers are said to live life ?in their heads? rather than ?from their hearts.? But even if that is so, why don't they think and write about the heart? Moreover, it can hardly have escaped philosophers' attention that matters of the heart are central to what we human beings value most about our lives, including our lives with animals. Philosophers write a lot about friendship and love, but they tend to do so in terms that leave out heartfelt connection. They speak rather of commitment to one another and each other's well-being, or taking each other as ends, or sharing deliberative standpoints or living life together, or a whole host of other topics, and much less about mutual emotional vulnerability and sharing and being in one another's hearts. Surely one explanation of philosophers' reticence is that talk of ?the heart? seems unavoidably metaphorical. It turns out to be easy enough, however, to cash the metaphor in if we simply take ?heart? refers to a cluster of emotional susceptibilities that have an essentially reciprocating structure. The heart aims at heartfelt connection-at shared experience of joys and sorrows, hopes and fears, and other personal emotions. We seek naturally to share these feelings with others and must suppress our natural tendencies if we wish to avoid doing so. Our heart's wish is to be open to other hearts in the hope that they will be open to ours, and thereby us, in return. This book is a systematic treatment-perhaps the first-of ?attitudes of the heart?-remorse (versus guilt), love, trust, gratitude, personal anger (versus righteous anger), jealousy, and others-and their role in mediating personal relationship, attachment, and connection. This is obviously interesting in its own right, but it also shows how heartfelt attitudes mirror more extensively studied ?reactive attitudes? of guilt, resentment, and blame (?attitudes of the will?). Whereas the latter mediate moral relations of mutual respect and accountability, attitudes of the heart are the currency of heartfelt connection and personal relationship.

They are rearranged and improvised upon, given new chords and altered melodies. These transformations might be small and seemingly unimportant, or they might be radical revisions. Which raises the question: across all of these various performances, what gives a standard its identity? In Hearing Double author Brian Kane answers that question by offering a new theory of musical works that can account for the unique challenges presented by standards. Building from the bottom up--from the actual practices of jazz musicians toward their philosophical implications--he gives a comprehensive theory of how a standard can undergo radical musical transformations yet remain identifiable. Through an analysis of the historical and cultural conditions under which standards came to prominence he shows how popular music from the 1930s to the 1960s was circulated and distributed and provides new insight into why the era of the standard emerged when it did. In addition, Kane addresses the aesthetic significance of standards and describes a special mode of listening that standards require. According to Kane, we effectively "hear double"--hearing an ideal song in our minds at the same time as we hear the live performance with our ears. When it comes to laws and policies that promote healthy eating--such as special taxes on sugary drinks and the banning of food deemed unhealthy--critics argue that these policies are paternalistic, and that they limit individual autonomy over food choices. In Healthy Eating Policy and Political Philosophy: A Public Reason Approach, Anne Barnhill and Matteo Bonotti show that both paternalistic justifications for healthy eating efforts and anti-paternalistic arguments against them can be grounded in perfectionist views that overly prioritize some values over others. The authors therefore propose a more inclusive, public reason approach to healthy eating policy that will be appealing to those who take pluralism and cultural diversity seriously, by providing a framework through which different kinds of values, including but not limited to autonomy and health, can be factored into the public justification for healthy eating efforts. Additionally, the book adopts a 'farm to fork' approach to the ethics of healthy eating efforts: it engages with theories and debates in political philosophy, considers the implications of different theoretical positions for healthy eating efforts, and then develops a concrete tool for assessing policies that will be of interest to both scholars and policymakers.
