When a Civil War substitute broker told business associates that "Men is cheep here to Day," he exposed an unsettling contradiction at the heart of the Union's war effort. Despite Northerners' devotion to the principles of free labor, the war produced rampant speculation and coercive labor arrangements that many Americans labeled fraudulent. Debates about this contradiction focused on employment agencies called "intelligence offices," institutions of dubious character that nevertheless served the military and domestic necessities of the Union army and Northern households. Northerners condemned labor agents for pocketing fees above and beyond contracts for wages between employers and employees. Yet the transactions these middlemen brokered with vulnerable Irish immigrants, Union soldiers and veterans, former slaves, and Confederate deserters defined the limits of independence in the wage labor economy and clarified who could prosper in it.Men Is Cheap shows that in the process of winning the war, Northerners were forced to grapple with the frauds of free labor. Labor brokers, by helping to staff the Union military and Yankee households, did indispensable work that helped the Northern state and Northern employers emerge victorious. They also gave rise to an economic and political system that enriched the managerial class at the expense of laborers--a reality that resonates to this day.

Clark among others improved on the original Austrian theory by Menger and Bohm-Bawerk by providing a coherent subjectivist foundation for the theories of production and distribution. They succeeded where economic theory before them failed – to develop the theories of interest, profit, wages and rents based solely on the principles of subjective value and marginal utility, eschewing the last remnants of the old cost of production models. Mens Rea in EU Antitrust Law

Under the purely economics-based approach to competition law, the central consideration is whether the conduct of undertakings has the effect of restricting competition or not. Such an ‘objective’ approach to antitrust enforcement leaves little room for subjective elements like intentions. But what happens when economic analysis reaches its limits? In this signal contribution, the author invokes the criminal law concept of mens rea, the idea of the ‘guilty mind’, thoroughly evaluating the normative cogency of mens rea evidence in the determination of antitrust infringements. Delving deep into the case law, the author views the subject from the standpoint of a confluence of various areas of law, including: the role of mens rea in the criminal law in France, Germany, and England and Wales; the different types of mens rea (e.g., intent, recklessness, negligence); mens rea in a corporate context; mens rea evidence in United States antitrust law; the notion of the ‘meeting of minds’ in Article 101 TFEU; relevance of intentions in the determination of the object of an agreement or concerted practice; relevance of intentions in the determination of abuse of a dominant position; and the role of mens rea in the determination of fines for antitrust breaches. The author also examines arguments both for and against the use of mens rea evidence in determining whether an antitrust infringement took place and how it should be punished. This is the first full-length assessment of what role mens rea evidence actually plays and should play in competition law even as the tools for antitrust analysis are meant to become increasingly objective. As a thoroughly researched and systematically presented commentary and analysis of the current status of the use of mens rea in antitrust enforcement and how the practice could develop, it is sure to be welcomed by practitioners as well as by policymakers and academics.

In der bekannten Situation des demographischen Wandels entstehen zunehmend neue Assistenzsysteme, insbesondere in der Mensch-Roboter-Kollaboration (MRK). Diese Systeme arbeiten nicht mehr isoliert hinter Zäunen, sondern Hand in Hand mit den Menschen. Sie sollen den Menschen bei monotonen oder kraftraubenden Arbeiten unterstützen oder entlasten. Durch die direkte Zusammenarbeit von Mensch und Maschine rücken Arbeitssicherheit und Ergonomie zunehmend in den Fokus. Klärungsbedarf gibt es bei der Gestaltung von MRK-Arbeitsplätzen und bei der Akzeptanz dieser Arbeitsplätze. Auch neue Aufgabenfelder sind im Gespräch, die sich z.B. in Pflege und Medizin erschließen lassen. Arbeitspsychologie und Human Factors bekommen in der roboterbasierten Automatisierung eine neue, wichtige Bedeutung. Zudem stellt sich die ethische Frage, ob diese neuen Roboter auf längere Sicht den Menschen entlasten oder ersetzen.Hintergrund dieser Veröffentlichung ist der Ladenburger Diskurs der Daimler und Benz Stiftung zum Thema MRK im März 2019. Dieser ist hervorragend besetzt mit einer deutlich interdisziplinären Ausrichtung, die in diesem Thema bislang einmalig ist. Die Teilnehmer sind Autoren dieses Buchs.
