Marriage Disputes in Medieval England
by Frederik PedersenIntimate details about the personal lives of medieval people are frustratingly rare. We seldom know what the men and women of the middle ages thought about marriage, let alone about sex. The records of the church courts of the province of York, mainly dating from the fourteenth century, provides a welcome light on private, family life and on individual reactions to it. They include a wide range of fascinating cases involving disputes about the validity of marriage, consent, sex, marital violence, impotence and property disputes. They also show how widely the laws of marriage were both known and accepted. Marriage Disputes in Medieval England offers a remarkable insight into personal life in the middle ages.
Marriage Equality: From Outlaws to In-Laws (Yale Law Library Series in Legal History and Reference)
by William N. Eskridge Christopher R. RianoThe definitive history of the marriage equality debate in the United States, praised by Library Journal as "beautifully and accessibly written. . . . .An essential work.” As a legal scholar who first argued in the early 1990s for a right to gay marriage, William N. Eskridge Jr. has been on the front lines of the debate over same†‘sex marriage for decades. In this book, Eskridge and his coauthor, Christopher R. Riano, offer a panoramic and definitive history of America’s marriage equality debate. The authors explore the deeply religious, rabidly political, frequently administrative, and pervasively constitutional features of the debate and consider all angles of its dramatic history. While giving a full account of the legal and political issues, the authors never lose sight of the personal stories of the people involved, or of the central place the right to marry holds in a person’s ability to enjoy the dignity of full citizenship. This is not a triumphalist or one†‘sided book but a thoughtful history of how the nation wrestled with an important question of moral and legal equality.
The Marriage Exchange: Property, Social Place, and Gender in Cities of the Low Countries, 1300-1550 (Women in Culture and Society)
by Martha C. HowellMedieval Douai was one of the wealthiest cloth towns of Flanders, and it left an enormous archive documenting the personal financial affairs of its citizens—wills, marriage agreements, business contracts, and records of court disputes over property rights of all kinds. Based on extensive research in this archive, this book reveals how these documents were produced in a centuries-long effort to regulate—and ultimately to redefine—property and gender relations. At the center of the transformation was a shift from a marital property regime based on custom to one based on contract. In the former, a widow typically inherited her husband's property; in the latter, she shared it with or simply held it for his family or offspring. Howell asks why the law changed as it did and assesses the law's effects on both social and gender meanings but she insists that the reform did not originate in general dissatisfaction with custom or a desire to disempower widows. Instead, it was born in a complex economic, social and cultural history during which Douaisiens gradually came to think about both property and gender in new ways.

Marriage in Seventeenth-Century English Political Thought
by Belinda Roberts PetersThis study traces the decline of marriage as a metaphor for political authority, subjection, and tyranny in Seventeenth-century political thought. An image that bound consent and contract with divine right absolutism, and irrevocably connected royal prerogatives with subjects' liberties, its disappearance in the middle decades of the century coincided with the full emergence of patriarchalist and social contract theories. If both these accepted the importance of 'fathers of families', neither would suggest that political government could be comparable to 'marriage'.

Marriage, Law and Modernity: Global Histories
by Julia MosesMarriage, Law and Modernity offers a global perspective on the modern history of marriage. Widespread recent debate has focused on the changing nature of families, characterized by both the rise of unmarried cohabitation and the legalization of same-sex marriage. However, historical understanding of these developments remains limited. How has marriage come to be the target of national legislation? Are recent policies on same-sex marriage part of a broader transformation? And, has marriage come to be similar across the globe despite claims about national, cultural and religious difference? This collection brings together scholars from across the world in order to offer a global perspective on the history of marriage. It unites legal, political and social history, and seeks to draw out commonalities and differences by exploring connections through empire, international law and international migration.

Marriage, Manners and Mobility in Early Modern Venice
by Alexander CowanThroughout history, marriage has been used as a method of creating and strengthening bonds between elites and the societies over which they ruled. Nowhere is this more apparent than in early modern Venice, where members of the patriciate looked to marital alliances with outsider brides to help maintain their position and social distinction in a fluid society. This book explores the parameters of upward social mobility, contemporary evaluations of social status and moral behaviour, and the place of marriage and concubinage within patrician society. Drawing heavily on the records of the Avogaria di Comun, which had the task of examining the social backgrounds and moral reputations of women from outside the patriciate who wished to marry patricians, this study provides a fascinating reconstruction of Venetian society as it was seen by individuals at every level.
