Humanity’s Children: ICC Jurisprudence and the Failure to Address the Genocidal Forcible Transfer of Children

This book addresses the phenomenon of children as the particular targets of extreme cruelty and genocide during armed conflict. Selected International Criminal Court cases are analyzed to illustrate the ICC‘s failure to address the genocidal forcible transfer of children to armed State and/or non-State groups or forces perpetrating mass atrocities and/or genocide. An original legal interpretation of children as a protected group in the context of the genocide provision of the Rome Statute is provided. The work also examines certain examples of the various modes in which armed State and/or non-State groups or forces perpetrating mass atrocities and/or genocide appropriate children and accomplish the genocidal forcible transfer of children to the perpetrator group. It is argued that the failure to prosecute the genocidal forcible transfer of children through the ICC mechanisms (where the Court has jurisdiction and the State has failed to meet its obligations in this regard) undermines the perceived gravity of this heinous international crime within the international community. Furthermore, this ICC failure to prosecute conflicts with the interests of justice and ultimately results in an erosion of the respect for the personhood and human dignity of children.

Despite clear legal rules and political commitments, no significant progress has been made in nuclear disarmament for two decades. Moreover, not even the use of these weapons has been banned to date. New ideas and strategies are therefore necessary. The author explores an alternative approach to arms control focusing on the human dimension rather than on States’ security: "humanization" of arms control! The book explores the preparatory work on arms control treaties and in particular the role of civil society. It analyzes the positive experiences of the movements against chemical weapons, anti-personnel mines, and cluster munitions, as well as the recent conclusion of the Arms Trade Treaty. The author examines the question of whether civil society will be able to replicate the success strategies that have been used, in particular, in the field of anti-personnel mines (Ottawa Convention) and cluster munitions (Oslo Convention) in the nuclear weapons field. Is there any reason why the most destructive weapons should not be outlawed by a legally binding instrument? The book also explains the effects of weapons, especially nuclear weapons, on human beings, the environment, and global development, thereby focusing on vulnerable groups, such as indigenous peoples, women, and children. It takes a broad approach to human rights, including economic, social, and cultural rights. The author concludes that the use of nuclear weapons is illegal under international humanitarian and human rights law and, moreover, constitutes international crimes under the Rome Statute of the International Criminal Court. In his general conclusions, the author makes concrete proposals for the progress toward a world without nuclear weapons.

Contemporary debates over issues as wide-ranging as the protection of wildernesses and endangered species, the spread of genetically modified organisms, the emergence of synthetic biology, and the advance of human enhancement, all of which seem to spin into deeper and more baffling questions with every change in the news cycle, often circle back to the same fundamental question: should there be limits to the human alteration of the natural world? A growing number of people view the human capacity to alter natural states of affairs -- from formerly wild spaces and things around us to crops and livestock to our own human nature -- as cause for moral alarm. That reaction raises a number of perplexing philosophical questions, however: Can we identify "natural" states of affairs at all? Does the idea of being morally concerned about the human relationship to nature make any sense? Should such a concern influence public policy and politics, or should government stay strenuously neutral on such matters? Through a study of moral debates about the environment, agricultural biotechnology, synthetic biology, and human enhancement, Gregory E. Kaebnick, a research scholar at The Hastings Center and editor of the Hastings Center Report, argues that concerns about the human alteration of nature can be legitimate and serious, but also that they are complex, contestable, and of limited political force. Kaebnick defends attempts to identify "natural" states of affairs by disentangling the nature/artifact distinction from metaphysical hoariness. Drawing on David Hume, he also defends moral standards for the human relationship to nature, arguing that they, and moral standards generally, should be understood as grounded in what Hume called the "passions." Yet what counts as "natural" can be delineated only roughly, he concludes, and moral standards for interaction with nature are less a matter of obligation than of ideals. Kaebnick also concludes, drawing on an interpretation of the liberal principle of neutrality, that government may support those standards but must be careful not to enforce them. Thus Kaebnick looks for a middle way on debates that have tended toward polarization. Humean Moral Pluralism

Michael B. Gill offers an original account of Humean moral pluralism. Moral pluralism is the view that there are different ultimate moral reasons for action, that those different reasons can sometimes come into conflict with each other, and that there exist no invariable ordering principles that tell us how to resolve such conflicts. If moral pluralism is true, we will at times have to act on moral decisions for which we can give no fully principled justification. Humeanism is the view that our moral judgments are based on our sentiments, that reason alone could not have given rise to our moral judgments, and that there are no mind-independent moral properties for our moral judgments to track. In this book, Gill shows that the combination of these two views produces a more accurate account of our moral experiences than the monistic, rationalist, and non-naturalist alternatives. He elucidates the historical origins of the Humean pluralist position in the works of David Hume, Adam Smith, and their eighteenth century contemporaries, and explains how recent work in moral psychology has advanced this position. And he argues for the position's superiority to the non-naturalist pluralism of W. D. Ross and the monism of Kantianism and consequentialism. The pluralist account of the content of morality has been traditionally perceived as belonging with non-naturalist intuitionism. The Humean sentimentalist account of morality has been traditionally perceived as not belonging with any view of morality's content at all. Humean Moral Pluralism explodes both those perceptions. It shows that pluralism and Humeanism belong together, and that they make a philosophically powerful couple.
