Assisted Reproductive Technologies in the Global South and North critically analyses the political and social frameworks of Assisted Reproductive Technology (ART), and its impact in different countries. In the context of a worldwide social pressure to conceive – particularly for women – this collection explores the effect of the development of ARTs, growing globalisation and reproductive medicalization on global societies. Providing an overview of the issues surrounding ART both in the Global South and North, this book analyses ART inequalities, commonalities and specificities in various countries, regions and on the transnational scene. From a multidisciplinary perspective and drawing on multisite studies, it highlights some new issues relating to ART (e.g. egg freezing, surrogacy) and discusses some older issues regarding infertility and its medical treatment (e.g. in vitro fertilisation, childless stigmatisation and access to treatment). This book aims to redress the balance between what is known about Assisted Reproductive Technologies in the Global North, and how the issue is investigated in the Global South. It aims to draw out the global similarities in the challenges that ARTs bring between these different areas of the world. Assisted suicide is a contentious topic and one which has been the subject of judicial and academic debate internationally. The central objective of the book is to approach the question of the ban’s compatibility with the European Convention on Human Rights afresh; freed from the constraints of the existing case law and its erroneous approach to the legal issues and selective reliance on empirical data. The book also examines the compatibility of the ban on assisted suicide with rights which have either been erroneously disregarded or not considered by either the domestic courts or the European Court of Human Rights. Having regard to human rights jurisprudence more broadly, including in the context of abortion, the research and analysis undertaken here demonstrates that the ban on assisted suicide violates the rights of a significant number of individuals to life, to freedom from torture or inhuman or degrading treatment and to private life. Such analysis does not depend on a strained or contrived approach to the rights at issue. Rather, the conclusions flow naturally from a coherent, logical application of the established principles governing those rights. While the focus of the book is the Suicide Act 1961, the conclusions reached have implications beyond England and Wales, including for the other devolved jurisdictions and international jurisdictions. Der Suizid stellt nicht nur a priori ein philosophisches, sondern auch ein rechtliches, ethisches, medizinisches sowie theologisches, polydimensionales Problem mit Auswirkungen auf die Tätigkeit als Arzt/Ärztin dar. Mit der Rechtsprechung des Bundesverfassungsgerichts vom 26.02.2020 kam es zu einem Paradigmenwechsel hin zur Stärkung des individuellen Selbstbestimmungsrechts. Damit fällt unter die Privatautonomie, das eigene Sterben selbst zu bestimmen – auch durch einen assistierten Suizid. In der Zukunft könnte der Arzt/die Ärztin in der Beschaffung von letalen Medikamenten oder bei Beratungen eine tragende Rolle spielen. Nur wie sehen die rechtlichen Gegebenheiten aus? Gibt es einen rechtsfreien Raum? Welche Aufgabe kommt dabei den Ärzten zu und treten Widersprüche auf? Welche Problematik besteht im Hinblick auf die Eruierung der Einwilligungs- und Urteilsfähigkeit des Suizidwilligen durch künstliche Intelligenz oder einen Psychiater/einer Psychiaterin? Mit der wissenschaftlichen Ausarbeitung soll ein Beitrag geleistet werden, dass das Thema die Würdigung erhält, welche es verdient.

Assisting International Justice: Cooperation Between UN Peace Operations and the International Criminal Court in the Democratic Republic of Congo

Although the International Criminal Court (ICC) - as the only permanent international court that addresses crimes against humanity, genocide, and war crimes - has important potential to end impunity and find justice for victims of atrocities, it is dependent on others for almost all aspects of its functioning. The Court has frequently relied on the peacekeeping operations that the UN deploys in the field and, over the past two decades, UN peacekeepers have provided logistical assistance and security to Court investigators, shared large amounts of information, and have even been involved in the arrest of Court suspects. But their track record has been inconsistent: they have sometimes refused to take action against people accused of war crimes and have found it difficult to balance their impartiality with court prosecutions. Despite the empirical importance of this phenomenon, we know preciously little about the circumstances under which it occurs. In Assisting International Justice, Buitelaar reveals the conditions under which UN peacekeepers address impunity in their mission areas. He presents an original single-country case study of assistance provided by the UN mission in the Democratic Republic of the Congo and a plausibility probe of other peace operations in ICC situation countries. Relying on new empirical material, including over 130 interviews of key decision-makers, and comprehensive archival research, this scholarly volume explores how the UN navigates the terrain of conflict mediation and punitive accountability and demonstrates the collaborative but contingent relationship between the UN and the ICC.

Assisting Victims of Terrorism: Towards a European Standard of Justice

The fight against terrorism is receiving increased awareness due to recent wor- wide large-scale terrorist acts, and only since then has some attention been directed specifically to victims of terrorism. Existing legal instruments of international b- ies like the European Union, the Council of Europe and the United Nations c- cerning victims of terrorism are relatively abstract or include victims of terrorism under the broader heading of victims of crime in general. In addition, policies and legislation relating to victims of crime or victims of terrorism vary widely on the domestic level. Against this background, the European Union commissioned a project that should aim to develop more extensive standards for the aid and ass- tance of victims of terrorism at the European level. This study provides the basis from which more extensive standards could be derived. The study focuses parti- larly on developing standards in the field of continuing assistance, access to justice, administration of justice and compensation to victims of terrorism. A novel feature of the approach is that also the possible utility of restorative justice approaches is examined. An important question to address was whether there is a real need to adopt s- cific standards for victims of terrorism, thereby implying that their needs might differ from victims of ordinary crime.
