Der Autor zweifelt die Konsistenz kriminalstrafrechtsakzessorischer Erklärungsansätze an. Im Rahmen der Ausarbeitung unternimmt Julian Lutzebäck eine Herleitung ad maiore ad minus: Zunächst werden die historischen Ursprünge des Rechtsinstituts der Erbunwürdigkeit dargestellt. Die sich anschließende kritische Überprüfung des Rechtsstands de lege lata kommt zu dem Ergebnis, dass nicht etwa einer strafrechtsakzessorischen Lesart, sondern einer Normanwendung am Maßstab des Schutzes des wahren Erblasserwillens der Vorrang einzuräumen ist.
