Common Immunity: Biopolitics in the Age of the Pandemic

After two years of global pandemic, it is no surprise that immunization is now at the center of our experience. From the medicalization of politics to the disciplining of individuals, from lockdowns to mass vaccination programs, contemporary societies seem to be firmly embedded in a syndrome of immunity. To understand the ambivalent effects of this development, it is necessary to go back to its modern genesis, when the languages of law, politics, and medicine began to merge into the biopolitical regime we have been living under for some time. This regime places a high priority on immunization and security: no security is more important than health security. The Covid-19 pandemic has taken the dynamic of immunization to a new level: for the first time in history, we see societies seeking to achieve generalized immunity in their entire populations through vaccination. This allows us to glimpse the possibility of a “common immunity” that strengthens the relation between community and immunity. The dramatic tensions we have experienced in recent years between security and freedom, norm and exception, power and existence, all refer to the complex relationship between community and immunity, the decisive features of which are reconstructed in this book. Building on the prescient argument originally developed two decades ago in Immunitas, Roberto Esposito demonstrates in this new book how the pandemic and our responses to it have brought into sharp relief the fundamental biopolitical conditions of our contemporary societies.

Written by a global network of experts, it explores the topic against the background of a variety of legal traditions.Common law and civil law are typically presented as antagonistic players on a field claimed by diverse legal systems: the former being based on precedent set by judges in deciding cases before them; the latter being founded on a set of rules intended to govern the decisions of those applying them. Perceived in this manner, common law and civil law differ in terms of the (main) source(s) of law; who is to create them; who is (merely) to draw from them; and whether the law itself is pure each step of the way, or whether the law’s purity may be tarnished when confronted with a set of contingent facts. These differences have deep roots in (legal) history – roots that allow us to trace them back to distinct traditions. Nevertheless, it is questionable whether the divide thus depicted is as great as it may seem: international and supranational legal systems unconcerned by national peculiarities appear to level the playing field. A normative understanding of constitutions seems to grant ever-greater authority to High Court decisions based on thinly worded maxims in countries that adhere to the civil law tradition. The challenges contemporary regulation faces call for ever-more detailed statutes governing the decisions of judges in the common law tradition. These and similar observations demand a structural reassessment of the role of judges, the power of precedent, the limits of legislation and other features often thought to be so different in common and civil law systems. The book addresses this reassessment.

Instead, he suggests, law can arise through a process of unplanned evolution in which those subject to law are bound, but not by the will of any identifiable human beings. Anglo-American common law, which evolved without a guiding human intelligence, showcases this. Over the centuries of its development, the common law process created the rules of contract, property, tort, and commercial law that define key aspects of liberal society. Common law's decentralized and continually evolving nature renders it resistant to political rent-seeking and responsive to changing economic and social conditions--allowing it to adapt to the needs of those it serves to protect, rather than to the desires of a powerful few. Hasnas suggests that while the enforcement of law may involve coercion, law in and of itself is not destined to be a vehicle for domination. Based on a strict comparative methodology, the phonology presented encapsulates the shared phonology of the dialects and reflects the real-world distinctions and categories found in the living dialects. For example, the initials preserve the tripartite division that includes voiced obstruents seen in Wú dialects; the finals are comparatively drawn based on the collective dialect data; and the syllable codas preserve the three-way contrasts of consonant stop endings seen in the Cantonese dialects. The English translation also includes innovative elements that render it even more useful for researchers than the Chinese original. The Common Sense of Science

Jacob Bronowski was, with Kenneth Clarke, the greatest popularizer of serious ideas in Britain between the mid 1950s and the early 1970s. Trained as a mathematician, he was equally at home with painting and physics, and wrote a series of brilliant books that tried to break down the barriers between 'the two cultures'. He denounced 'the destructive modern prejudice that art and science are different and somehow incompatible interests'. He wrote a fine book on William Blake while running the National Coal Board's research establishment. The Common Sense of Science, first published in 1951, is a vivid attempt to explain in ordinary language how science is done and how scientists think. He isolates three creative ideas that have been central to science: the idea of order, the idea of causes and the idea of chance. For Bronowski, these were common-sense ideas that became immensely powerful and productive when applied to a vision of the world that broke with the medieval notion of a world of things ordered according to their ideal natures. Instead, Galileo, Huyghens and Newton and their contemporaries imagined 'a world of events running in a steady mechanism of before and after'. We are still living with the consequences of this search for order and causality within the facts that the world presents to us.

Pascal does not state the problem in precisely these terms regarding the limits of Reason, yet it seems clear that the dilemma he is indicating involves the question of the relation of religious beliefs to the compass of Reason. He does not, however-at least in the passage cited-indicate that the problem is a question of either/or: either Reason and no Religion, or Religion and Irrationality. Rather, he seems to be simply stating what he perceives to be a simple matter of fact. If Reason is allowed to be the judge of all Religion, then all Religion must abandon any elements that are either contrary to reason or cannot be shown to be in accord with Reason. On the other hand, if Reason is not allowed to judge Religion at all, then Religion will be absurd and ridiculous.
