The Company They Keep: How Partisan Divisions Came to the Supreme Court

Are Supreme Court justices swayed by the political environment that surrounds them? Most people think "yes," and they point to the influence of the general public and the other branches of government on the Court. It is not that simple, however. As the eminent law and politics scholars Neal Devins and Lawrence Baum show in The Company They Keep, justices today are reacting far more to subtle social forces in their own elite legal world than to pressure from the other branches of government or mass public opinion. In particular, the authors draw from social psychology research to show why Justices are apt to follow the lead of the elite social networks that they are a part of. The evidence is strong: Justices take cues primarily from the people who are closest to them and whose approval they care most about: political, social, and professional elites. In an era of strong partisan polarization, elite social networks are largely bifurcated by partisan and ideological loyalties, and the Justices reflect that division. The result is a Court in which the Justices' ideological stances reflect the dominant views in the appointing president's party. This comparative study of European time transfers reveals the full extent of transfers in the form of unpaid work and highlights the existence of important gender differences in household time production. A large quantity of goods and services are produced by household members for their own consumption, without involving market transactions. Despite the economic and social importance of unpaid work, these productive activities are largely invisible to traditional national economic accounts. As a consequence, standard measures of intergenerational transfers typically ignore household production, and thus underestimate the overall value of goods and services produced over the life cycle; in particular, the economic contribution of females. The book uses a life course approach to offer policy-relevant insights into the effect of demographic and social change on intergenerational ties and gender inequality in household production.

As the social sciences evolved methodologically, however, many dismissed area studies as favoring narrow description over general theory. Still, area studies continues to plays a key, if unacknowledged, role in bringing new data, new theories, and valuable policy-relevant insights to social sciences. In Comparative Area Studies, three leading figures in the field have gathered an international group of scholars in a volume that promises to be a landmark in a resurgent field.
