The Dynamics of Nationalist Movements in Catalonia and the Basque Country offers an exploration of the dynamics behind contemporary shifts in the orientation of nationalist parties and movements with reference to Catalonia and the Basque country in Spain. The chapters were originally papers presented at a workshop held at the Barcelona Centre for International Affairs (CIDOB) in September 2014 as part of a research project on ‘The Dynamics of Nationalist Evolution in Contemporary Spain’, whose purpose was to gain a better understanding of why regionally-based nationalist movements have experienced shifting relationships with the Spanish state over time, in some periods appearing content with accommodation between central and regional government and at other times pushing to go beyond autonomist demands to seek sovereignty or even attain full independence. The volume is one of the first to focus comparatively on the rise of pro-sovereignty politics in mainstream nationalist parties, whose evolution has also featured more traditional impulses towards territorial accommodation within the wider state. Using the exceptionally rich laboratory provided by Spain, the book explores the dynamics behind shifts in the orientation of nationalist parties and movements once they have established themselves as electorally successful at regional level. Dimensions to the analysis include: the interaction of nationalist parties with central government; pressures from their support bases; competition between parties within the home region; and international influences. This title is innovative in bringing together experts with a range of disciplinary approaches: primarily political scientists but also historians and scholars located at the cusp between social sciences and humanities.
Contesting Symbolic Landscape in Jerusalem: Jewish/Islamic Conflict over the Museum of Tolerance at Mamilla Cemetery
by Yitzhak ReiterIn 2006 a dispute broke out regarding an initiative by the Simon Wiesenthal Center in Los Angeles (backed by Israeli authorities) to construct a Museum of Tolerance (MoT) in West Jerusalem. The museum was to be built on a plot of land that in the past had been part of the historic Muslim Mamilla Cemetery, which since the 1980s has served as a municipal parking lot. Debate centred on whether construction of a museum dedicated to human dignity on Muslim cemeterial land was justified. The Northern Islamic Movement and a group of 70 academics and eight Israeli civil society organizations (including rabbis) opposed the project, but their petition to Israel's High Court of Justice failed. Yitzhak Reiter presents the public and legal dilemmas at the individual level (an act of insensitivity to the Muslim minority in Jerusalem); at the political level (the right of equal treatment by the state and the right to administer holy properties [waqf] according to religious law and rulings of shari'a [Islamic law] courts); and at the universal level (can conflict over a holy place be addressed objectively from the ideological/political positions that the place symbolizes, and is a secular civil court competent/appropriate to adjudicate a religious conflict). Research for this book integrates a multi-disciplinary approach involving history, identity politics, and conflict resolution. Sources include documents obtained from the Shari'a Court of Jerusalem and Israel's High Court of Justice, as well as Islamic law and Israeli civil law literature, reports of experts submitted to the courts, and personal participation of the author, including discussions with key players and informants. The Mamilla dispute reflects a microcosm of conflicts over religious and national symbols of cultural heritage as well as Jewish majorityArab minority tensions within Israel.
Context, Cognition and Conditionals (Palgrave Studies in Pragmatics, Language and Cognition)
by Chi-Hé ElderThis book proposes a semantic theory of conditionals that can account for (i) the variability in usages that conditional sentences can be put; and (ii) both conditional sentences of the form ‘if p, q’ and those conditional thoughts that are expressed without using ‘if’. It presents theoretical arguments as well as empirical evidence from English and other languages in support of the thesis that an adequate study of conditionals has to go beyond an analysis of specific sentence forms or lexical items. The resulting perspective on conditionals is one in which conditionality is located at a higher level than that of the sentence; namely, at the level of thought. The author argues that it is only through adopting such a perspective, and with it, a commitment to context-dependent semantics, that we can successfully represent conditional utterances as they are used and understood by ordinary language users. It will be of interest to students and scholars working on the semantics of conditionals in the fields of linguistics (especially semantics and pragmatics) and philosophy of language.

Building onto a theoretical framework developed by the philosopher and logician Saul Kripke, the author also presents a new approach to these truths. The first part of the book details the many theories on contingent a priori truths. The coverage examines the cases of Kripke and David Kaplan, Donnellan and the de re requirement, Evans and weak contingency, as well as Plantinga, Salmon, Soames, and the pseudo a priori. Overall, it provides a systematic discussion and critical review of all these many positions. Next, the author develops an alternative approach. His working hypothesis is that performative verbs must play a central role in Kripke’s examples, even if they do not show up at the surface structure of the corresponding sentences. This opens up an entirely new way of looking at Kripke’s cases and of treating them by exploring some aspects of the theory of illocutionary acts. His discussion also examines brute facts and institutional facts, indexicals and performatives, as well as Frege’s theory of definitions. Providing an authoritative exploration into contingent a priori truths, this book will be of interest to students, academics, and researchers in philosophy and logic.

Moving from the unconscionability doctrine, it criticizes (and in some cases refutes) its main conclusions based on criteria which are usually invoked to sustain the need for public intervention to protect consumers, and specifically related to Law (contract complexity), Psychology (consumer lack of sophistication criterion) and Economics (market structure criterion).It also analyzes the effects of different regulations, such as banning vexatious clauses or mandating disclosure clauses, showing that none of them protect consumers, but in fact prove to be harmful when consumers are more vulnerable, that is whenever sellers can exploit some degree of market power.In closing, the book combines these disparate aspects, arguing that the solution (if any) to the problem of consumer exploitation and market inefficiency associated with the use of contracts of adhesion in these contexts cannot be found in removing or prohibiting hidden clauses, but instead has to take into account the effects of these clauses on the contract as a whole.

If this approach is adopted the relevant knowledge and the procedures applied clearly exhibit a logic of their own. This point of view leads to a methodological and even an epistemological analysis of the theoretical structure and the specific methods of procedure characteristic of modern technology. Investigations of this kind, that can be described as belonging to an ana lytical philosophy of technology, form the topic of this anthology. The type of research in question here is closely akin to that of the philosophy of science. But it is an astonishing fact that the commonly accepted and carefully investigated philosophy of science has not yet found its counterpart in an established philosophy of technology.
