Cultural Heritage and International Law: Objects, Means and Ends of International Protection

This book explores the objects, means and ends of international cultural heritage protection. It starts from a broad conception of cultural heritage that encompasses both tangible property, such as museum objects or buildings, and intangible heritage, such as languages and traditions. Cultural heritage thus defined is protected by various legal regimes, including the law of armed conflicts, UNESCO Conventions and international criminal law. With a view to strengthening international protection, the authors analyze existing regimes and elaborate innovative concepts, such as blue helmets of culture and safe havens for endangered cultural heritage. Finally, the ends of international protection come to the fore, and the authors address possible conflicts between protecting cultural diversity and wishes to strengthen cultural identity.

Customary Law Today

This book addresses current practices in customary law. It includes contributions by scholars from various legal systems (the USA, France, Israel, Canada etc.), who examine the current impacts of customary law on various aspects of private law, constitutional law, business law, international law and criminal law. In addition, the book expands the traditional concept of the rule of law, and argues that lawyers should not narrowly focus on statutory law, but should instead pay more attention to the impact of practices on “real legal life.” It states that the observation of practices calls for a stronger focus on usage, customs and traditions in our legal systems – the idea being not to replace statutory law, but to complement it with customary observations.

Exploring the Interior: Essays On Literary And Cultural History

In this fascinating collection of essays Harvard Emeritus Professor Karl S. Guthke examines the ways in which, for European scholars and writers of the eighteenth and early nineteenth century, world-wide geographical exploration led to an exploration of the self. Guthke explains how in the age of Enlightenment and beyond intellectual developments were fuelled by excitement about what Ulrich Im Hof called "the grand opening-up of the wide world”, especially of the interior of the non-European continents. This outward turn was complemented by a fascination with "the world within” as anthropology and ethnology focused on the humanity of the indigenous populations of far-away lands – an interest in human nature that suggested a way for Europeans to understand themselves, encapsulated in Gauguin’s Tahitian rumination "What are we?” The essays in the first half of the book discuss first- or second-hand, physical or mental encounters with the exotic lands and populations beyond the supposed cradle of civilisation. The works of literature and documents of cultural life featured in these essays bear testimony to the crossing not only of geographical, ethnological, and cultural borders but also of borders of a variety of intellectual activities and interests. The second section examines the growing interest in astronomy and the engagement with imagined worlds in the universe, again with a view to understanding homo sapiens, as compared now to the extra-terrestrials that were confidently assumed to exist. The final group of essays focuses on the exploration of the landscape of what was called "the universe within”; featuring, among a variety of other texts, Schiller’s plays The Maid of Orleans and William Tell, these essays observe and analyse what Erich Heller termed "The Artist’s Journey into the Interior.” This collection, which travels from the interior of continents to the interior of the mind, is itself a set of explorations that revel in the discovery of what was half-hidden in language. Geometric Aspects of the Trace Formula (Simons Symposia)

The Red Countess: Select Autobiographical and Fictional Writing of Hermynia Zur Mühlen (1883-1951)

Born into a distinguished aristocratic family of the old Habsburg Empire, Hermynia Zur Mühlen spent much of her childhood and early youth travelling in Europe and North Africa with her diplomat father. Never comfortable with the traditional roles women were expected to play, she broke as a young adult both with her family and, after five years on his estate in the old Czarist Russia, with her German Junker husband, and set out as an independent, free-thinking individual, earning a precarious living as a writer. She translated over 70 books from English, French and Russian into German, notably the novels of Upton Sinclair, which she turned into best-sellers in Germany; produced a series of detective novels under a pseudonym; wrote seven engaging and thought-provoking novels of her own, six of which were translated into English; contributed countless insightful short stories and articles to newspapers and magazines; and, having become a committed socialist, achieved international renown in the 1920s with her Fairy Tales for Workers’ Children, which were widely translated including into Chinese and Japanese. Because of her fervent and outspoken opposition to National Socialism, she and her life-long Jewish partner, Stefan Klein, had to flee first Germany, where they had settled, and then, in 1938, her native Austria. They found refuge in England, where Zur Mühlen died, forgotten and virtually penniless, in 1951. In 1865, British polymath Francis Galton published his initial thoughts about the scientific field that would become ‘eugenics.’ The same year, Russian physician Vasilii Florinskii addressed similar issues in a sizeable treatise, entitled Human Perfection and Degeneration. Initially unheralded, Florinskii’s book would go on to have a remarkable afterlife in twentieth- and twenty-first-century Russia. In this lucid and insightful work, Nikolai Krementsov argues that the concept of eugenics brings together ideas, values, practices, and fears energised by a focus on the future. It has proven so seductive to different groups over time because it provides a way to grapple with fundamental existential questions of human nature and destiny. With and Without Galton develops this argument by tracing the life-story of Florinskii’s monograph from its uncelebrated arrival amid the Russian empire’s Great Reforms, to its reissue after the Bolshevik Revolution, its decline under Stalinism, and its subsequent resurgence: first, as a founding document of medical genetics, and most recently, as a manifesto for nationalists and racial purists. Krementsov’s meticulously researched ‘biography of a book’ sheds light not only on the peculiar fate of eugenics in Russia, but also on its convoluted transnational history, elucidating the field’s protean nature and its continuing and contested appeal to diverse audiences, multiple local trajectories, and global trends. Décomposition-coordination en optimisation déterministe et stochastique (Mathématiques et Applications #81)

Ce livre considère le traitement de problèmes d'optimisation de grande taille. L'idée est d'éclater le problème d'optimisation global en sous-problèmes plus petits, donc plus faciles à résoudre, chacun impliquant l'un des sous-systèmes (décomposition), mais sans renoncer à obtenir l'optimum global, ce qui nécessite d'utiliser une procédure itérative (coordination). Cette théorie est présentée aussi bien dans le contexte de l'optimisation déterministe que stochastique. Ce matériel a été enseigné par les auteurs dans divers cours de 3ème cycle et également mis en œuvre dans de nombreuses applications industrielles. Des exercices et problèmes avec corrigés illustrent le potentiel de cette approche.This book discusses large-scale optimization problems involving systems made up of interconnected subsystems. The main viewpoint is to break down the overall optimization problem into smaller, easier-to-solve subproblems, each involving one subsystem (decomposition), without sacrificing the objective of achieving the global optimum, which requires an iterative process (coordination). This topic emerged in the 70’s in the context of deterministic optimization. The present book describes the main principles and methods of decomposition-coordination using typical situations, then proposes a general framework that makes it possible to construct well-behaved algorithms and to study their convergence. This theory is presented in the context of deterministic as well as stochastic optimization, and has been taught by the authors in graduate courses and implemented in numerous industrial applications. The book also provides exercises and problems with answers to illustrate the potential of this approach.

Bereits im 18. Jahrhundert und zuvor besann man sich auf gemeinsame Werte und eine gemeinsame Geschichte; die damals gestellten Fragen ähneln in vielen Bereichen den heutigen. Die Autoren und Philosophen der Aufklärung haben so bereits über die Möglichkeiten einer europäischen Einigung zwecks Sicherung des Friedens auf dem Kontinent nachgedacht. Die Texte der vorliegenden Anthologie, verfasst sowohl von den großen Denkern der Zeit (Rousseau, Montesquieu, Voltaire, Kant, Hume oder Germaine de Staël) wie auch von weniger bekannten oder gar in Vergessenheit geratenen, präsentieren, mit einigen chronologischen Exkursen (von Sully bis Victor Hugo), die Ideen der Denker eines weit gefassten 18. Jahrhunderts zu Europa, seiner Geschichte, seiner Vielfalt, aber auch zu den Gemeinsamkeiten der Nationen, die trotz ihrer Vielfalt eine geographische Einheit bilden. Die Texte zeigen uns so die historischen Ursprünge des Projektes der europäischen Einigung, erörtern die Vorteile einer assoziierten Türkei und einer Einbindung des Maghreb sowie die Bedeutung des europäischen Handels. During the Enlightenment, many men and women of letters envisaged the continent’s future in particular when stressing their hope that peace could be secured in Europe. The texts gathered here, and signed by major thinkers of the time (Rousseau, Montesquieu, Voltaire, Kant, Hume or Staël for instance), as well as by writers history has forgotten, present the reflections, with a couple of chronological extensions (from Sully to Victor Hugo) of authors from the long eighteenth century—the French Empire and the fall of Napoleon generated numerous upheavals—on Europe, its history, its diversity, but also on what the nations, which, in all their diversity, make up a geographical unit, have in common. They show the historical origins of the project of a European union, the desire to consolidate the continent’s ties to the Maghreb or to Turkey, the importance granted to commerce and the worries engendered by history’s convulsions, but also the hope vested in future generations. The Société française d’étude du XVIIIe siècle, Augsburg University and the University of Oxford have generously contributed towards the publication of this volume.

Le livre "En chemin", destiné aux jeunes lecteurs, raconte l'histoire de Kevin qui rentre chez lui après l'école. Accompagné de sa mère, il observe les événements qui se déroulent le long du chemin. Ils rencontrent divers obstacles, notamment un camion en panne qui bloque la route. Malgré cela, Kevin se réjouit de retrouver son fidèle chien une fois arrivé chez lui. Heidegger et les grandes lignes dʼune phénoménologie herméneutique du christianisme primitif (Phaenomenologica #221)

Cet ouvrage propose une étude de la pensée du jeune Heidegger au prisme de sa philosophie de la religion, reconstituée pour l’occasion dans ses rapports aux philosophies dominantes de son époque d’une part, et à l’histoire de la théologie et de l’exégèse d’autre part. Pour ce faire, il prend pour fil directeur le célèbre cours « Introduction à la phénoménologie de la religion » prononcé au semestre d’hiver 1920/1921 à l’Université de Freiburg, dont l’édition officielle est ici amendée en de multiples endroits. Une première partie s’attache à démontrer l’antériorité et l’excès de la vie sur toute théorie en interrogeant successivement la redéfinition de l’acte de penser en tant qu’expérience sui generis, l’explication ambivalente de Heidegger avec Ernst Troeltsch, interlocuteur jadis incontournable sur le terrain de la philosophe de la religion, la quête d’une notion d’historicité plus fondamentale et plus radicale que celle en usage au sein de la philosophie de l’histoire et de la science historique, et la problématisation d’un outil méthodique énigmatique, l’indication formelle, en discussion serrée avec la doctrine de Husserl. La seconde partie suit Heidegger pas à pas dans son explication phénoménologico-herméneutique de passages choisis des Epîtres de saint Paul, son interprétation de la grande Tradition chrétienne, et son dialogue crypté avec les représentants majeurs de la théologie néo-testamentaire et de l´histoire des dogmes et des religions dans l’Allemagne de la seconde moitié du xixe et du début du xxe siècle. L’ensemble se présente comme un commentaire critique tout à la fois historique et systématique du cours précité et veut servir de prolégomènes, non seulement à une approche originale du corpus heideggérien, mais encore à une philosophie de la religion régénérée dans la dialectique originaire entre le phénomène du vécu et le phénomène scripturaire.

The Idea of Europe: Enlightenment Perspectives (Open Book Classics Ser. #Vol. 7)

In view of the challenges—many of which are political—that different European countries are currently facing, scholars who work on the eighteenth century have compiled this anthology which includes earlier recognitions of common values and past considerations of questions which often remain pertinent nowadays. During the Enlightenment, many men and women of letters envisaged the continent’s future in particular when stressing their hope that peace could be secured in Europe. The texts gathered here, and signed by major thinkers of the time (Rousseau, Montesquieu, Voltaire, Kant, Hume or Staël for instance), as well as by writers history has forgotten, present the reflections, with a couple of chronological extensions (from Sully to Victor Hugo) of authors from the long eighteenth century—the French Empire and the fall of Napoleon generated numerous upheavals—on Europe, its history, its diversity, but also on what the nations, which, in all their diversity, make up a geographical unit, have in common. They show the historical origins of the project of a European union, the desire to consolidate the continent’s ties to the Maghreb or to Turkey, the importance granted to commerce and the worries engendered by history’s convulsions, but also the hope vested in future generations. The Idea of Europe follows its sister edition in French, L’idée de l’Europe au Siècle des Lumières, also published by Open Book. The Société française d’étude du XVIIIe siècle, Augsburg University and the University of Oxford have generously contributed towards the publication of this volume.

Interprétations phénoménologiques de la 'Physique' d’Aristote chez Heidegger et Patočka (Phaenomenologica #223)

Cet ouvrage met en œuvre une confrontation philosophique entre Heidegger et Patočka, deux figures majeures de la tradition phénoménologique, en prenant pour fil conducteur leurs interprétations respectives des concepts fondamentaux de la Physique d’Aristote. Mais tout d’abord, le point d’accord : l’herméneutique de l’aristotélisme représente aux yeux de Heidegger et de Patočka une première entrée pensante dans l’affaire même de la pensée, où le mouvement (κίνησις/μεταβολή), irréductible au déplacement d’un étant dans l’espace, désigne le procès d’advenue au paraître qui sous-tend l’éclosion à l’être des choses. Aristote met au jour la différence ontologique entre l’être et l’étant, en sorte que la Physique constitue de ce point de vue pour Heidegger et Patočka le véritable Grundbuch de la philosophie occidentale. Cependant, Heidegger et Patočka ne comprennent pas de la même manière le sens de ce mouvement ontologique au cœur de l’être (φύσις). À travers l’examen de ces différences, l’enjeu de cet ouvrage est de mettre en évidence un point de tension au sein de la phénoménologie qui n’a pas encore été suffisamment remarqué, entre d’une part l’approche heideggérienne qui soumet l’être au sens (λόγος), et s’expose de la sorte au risque d’un anthropocentrisme ontologique larvé. Et d’autre part, la tentative d’un réalisme phénoménologique, dont Patočka fut l’un des représentants, dans la double mesure où il brise l’identité classique de l’être et de l’intelligibilité, et où il pense l’homme comme radicalement décentré, prétendant en finir ainsi avec le sujet et tous ses avatars (c’est là le sens de la fameuse « phénoménologie asubjective ») ; réalisme radical dont on peut toutefois se demander s’il ne met pas à mal le paradigme phénoménologique de l’a priori de la corrélation entre l’apparaître et ses modes subjectifs de donnée, et s’il ne remet pas en cause ainsi la possibilité même de la phénoménologie en la poussant au-delà de sa propre limite.
